Major Hospitals in Staten Island
Staten Island has two major hospitals designated by Medicare as birthing-friendly facilities. These include Richmond University Medical Center, or RUMC, and Staten Island University Hospital, or SIUH. RUMC delivers nearly 3,000 babies every year with a survival rate of 997.2 out of every 1,000 births. SIUH’s new Gruppuso Family Women & Newborn Center offers labor and delivery services with a lower C-section rate than the national average, as well as high-risk pregnancy management services.
On Medicare.gov, RUMC has a one-star rating, with reviewers citing a lack of timely and effective care, staff assistance, and aftercare instructions. SIUH has a two-star rating, with reviewers citing noise complaints, poor staff communication, and delayed care.

Notable Birth Injury Lawsuits in Staten Island
Both Richmond University Medical Center and Staten Island University Hospital have faced several notable birth injury and wrongful death lawsuits involving childbirth since the early 2000s. The suits alleged multiple types of birth injuries with varying causes, with several resulting in significant settlements or jury verdicts.
Pezulich v. Michael A. Grecco (2015)
The plaintiff’s wife gave birth at Richmond University Medical Center in 2015, and attending physician Michael A. Grecco treated her. During a prenatal visit four days before birth, Grecco noted she had a cervical myoma, which he planned to remove after delivery. However, the woman went into labor spontaneously, necessitating a C-section, and the doctor discovered the myoma was much larger than previously thought.
Three months after the birth, Grecco ordered tests that revealed cervical cancer, which led to her death in December 2015. Grecco was found negligent for failing to refer the woman to a gynecologic oncologist in a timely manner.
Hunter v. Richmond University Medical Center (2008)
A mother was discharged from Richmond University Medical Center in 2008 despite ongoing prenatal issues, but was eventually admitted with pre-term rupture of membranes, leading to an emergency C-section. Plaintiffs alleged that the hospital’s negligence caused multiple serious health issues for the mother.
Hyman v. Staten Island University Hospital (2006)
A jury awarded $510,000 to the family of a 4-year-old boy who suffered brain injuries due to oxygen deprivation during delivery at Staten Island University Hospital in 2006. The jury found the hospital and obstetrician Paul Heltzer liable for medical malpractice.
Marlowe v. Staten Island University Hospital (2001)
In 2001, health care providers at Staten Island University Hospital failed to provide appropriate care to address fetal distress during one woman’s labor and delivery process. As a result, the baby was born with severe brain damage and died a few days later.
A court found that health care providers were liable for failing to properly monitor the fetal heart rate and for failing to respond to signs of fetal distress during delivery, and awarded the plaintiff significant damages.
Staten Island Birth Injury Lawsuit Statute of Limitations
New York’s statute of limitations for medical malpractice claims typically requires lawsuits to be filed within 2.5 years of when the incident occurred or the harm is reasonably discovered. While state law pauses the filing period for minors until they reach age 18, New York has imposed a hard cap of 10 years from the date of the incident for medical malpractice. Thus, families typically have until the child’s 10th birthday to file a lawsuit on behalf of their minor child.
In the case of wrongful death caused by a birth injury, the statute of limitations in New York is much shorter—families generally have just two years from the death to file a lawsuit. It’s important to act early after a birth injury to gather evidence before it becomes more difficult to find.
Who Can File a Birth Injury Lawsuit in Staten Island?
Parents or legal guardians of injured babies can file birth injury lawsuits in New York, and in some cases, extended family members may be able to file if the parents are unable to do so. These claims are filed on behalf of the minor child.
If a birth injury has resulted in the death of a child, the family may be able to file a wrongful death claim if a medical provider’s negligence caused the death.
How Much Does a Birth Injury Lawyer Cost in Staten Island?
There are no set costs to hire a New York City birth injury lawyer, as fees depend on several factors, including the case’s complexity and whether it settles or goes to trial. Most Staten Island birth injury attorneys work on a contingency fee basis, meaning you will not have to pay any upfront costs. Instead, your legal team only gets paid if you recover compensation through a birth injury settlement or jury verdict.
What Compensation Is Available in a Staten Island Birth Injury Case?
In a birth injury claim, you can usually seek compensation for two types of damages: economic and non-economic. Economic damages cover the quantifiable monetary losses caused by the injury, while non-economic damages compensate you for more subjective losses, such as emotional and physical suffering.
Compensation in a birth injury claim may cover the following losses:
- Current & future medical care
- Therapy & rehabilitation
- Assistive devices
- Home modifications
- Lost earning capacity and educational opportunities
- Pain and suffering
- Emotional distress
- Loss of enjoyment of life
In wrongful death cases, families may seek compensation for funeral and burial expenses, medical costs, and other losses.
